1. Scope of Work
Website Store will provide services as agreed upon in writing, including but not limited to website design, hosting, configuration, and digital solutions. The scope of work will be outlined clearly in a written agreement or proposal.
2. Client Responsibilities
- Provide all necessary access, materials, and information required to complete the service.
- Ensure that third-party tools, configurations, or platforms are suitable for the intended purpose.
- Be available for communication, approvals, and reviews throughout the process.
Failure to fulfill these responsibilities may result in delays, additional costs, or project termination.
3. Refund Policy
All sales are final. Website Store does not offer refunds for completed work or services rendered.
- If a project is delayed due to the client’s inaction or failure to provide required information, no refund will be issued.
- Partial refunds may only be considered at our sole discretion for uncompleted work, provided the reason is communicated in writing.
4. Chargebacks and Disputes
By engaging with Website Store, you agree to:
- Communicate any concerns or disputes with us directly in writing before initiating a chargeback with your bank or payment provider.
- Acknowledge that chargebacks filed after services have been rendered constitute a breach of this agreement.
Website Store reserves the right to pursue legal remedies, including small claims court or other legal actions, to recover funds improperly refunded through chargebacks. All costs associated with such disputes, including legal fees and collection costs, will be your responsibility.
5. Limitation of Liability
- Client errors, third-party configurations, or misuse of services.
- Issues arising from third-party software, platforms, or integrations beyond our control.
- Loss of business, revenue, or data caused by any delays or technical issues unrelated to our direct services.
Our total liability for any claim shall not exceed the amount paid for the specific service in question.
6. Termination of Service
- The client breaches these Terms of Service.
- The client is abusive, uncooperative, or engages in unethical conduct.
In the event of termination, all completed work will be billed, and no refunds will be issued.
7. Dispute Resolution
- Direct Negotiation: Parties will first attempt to resolve the dispute amicably through written communication.
- Mediation: If unresolved, parties may agree to third-party mediation.
- Small Claims Court: If necessary, disputes will be settled in small claims court in the jurisdiction of Queens, NY.
8. Governing Law
These Terms of Service are governed by the laws of the State of New York, without regard to conflicts of law principles.
9. Acceptance of Terms
By engaging with Website Store, you acknowledge that you have read, understood, and agree to these Terms of Service.
